1. Acceptance of Terms

These Terms & Conditions ("Terms") apply to all sales of goods and use of the website operated by Jamal Catering Equipment's Ltd ("the Company", "we", "us", "our"). By placing an order or using this website, you agree to be bound by these Terms.

2. Who We Are

2.1 We are a supplier of new and used commercial catering equipment for business and professional use within the United Kingdom.

3. Goods Being Sold

3.1 All sales are deemed to be business-to-business (B2B) transactions. Where goods are purchased for personal or non-business use, the Customer acknowledges that such purchases are not covered by the Consumer Contracts (Distance Selling) Regulations. Accordingly, Jamal Catering Equipment's Ltd is not obliged to offer cancellations, refunds, or returns once an order has been confirmed, even if the goods remain unused.

3.2 Jamal Catering Equipment's Ltd makes every reasonable effort to ensure that all product descriptions, specifications, and information provided are accurate. Product images are for illustrative purposes only and, on occasion, actual products may vary slightly in appearance, dimensions, colour, or features due to manufacturing changes, product updates, or refurbishment processes. The Company shall not be held liable for minor variations or inaccuracies.

3.3 Customers are strongly advised to carefully review all product specifications, descriptions, and details prior to placing an order to ensure the goods are suitable for their intended purpose. By proceeding with a purchase, the Customer confirms that they have reviewed and accepted the product information as provided.

3.4 Upon delivery, the Customer must inspect the goods before acceptance. Acceptance of delivery shall constitute confirmation that the goods supplied correspond with the description provided at the time of sale and are in satisfactory condition, subject to the applicable warranty terms.

4. Pricing and Payment

4.1 All prices quoted by Jamal Catering Equipment's Ltd are exclusive of VAT unless expressly stated otherwise.

4.2 Prices are subject to change without prior notice; however, confirmed orders will be charged at the price agreed at the time of order confirmation.

4.3 Payment terms must be agreed in advance. Unless otherwise agreed in writing, full payment is required prior to dispatch or collection of goods.

4.4 Jamal Catering Equipment's Ltd reserves the right to withhold delivery of goods until payment has been received in full.

4.5 Any overdue payments may be subject to interest and recovery costs in accordance with applicable legislation.

4.6 All payments shall be made using the approved payment methods specified by the Company.

5. Delivery

5.1 We offer two types of delivery:

5.1.1 Company Delivery
Delivery carried out using our own transport and personnel. Delivery scope (kerbside, placement, or assistance) will be confirmed prior to dispatch.

5.1.2 Third-Party Courier Delivery
Delivery arranged via external courier services. Delivery is typically kerbside only.

5.2 Delivery times are estimates only and not guaranteed.

5.3 Customers are responsible for ensuring clear and safe access to the delivery location.

5.4 We shall not be liable for delays caused by traffic, weather, or third-party couriers.

6. Click and Collect

6.1 All Click and Collect orders must be paid in full prior to collection.

6.2 Customers are required to notify Jamal Catering Equipment's Ltd at least one (1) hour in advance of the intended collection time to ensure goods are prepared and available.

6.3 All Click and Collect orders must be collected within ten (10) business days from the date the order is confirmed as ready for collection.

6.4 Failure to collect goods within this period may result in storage charges being applied at the Company's discretion. Continued failure to collect may also result in order cancellation and/or resale of the goods, without refund, to recover costs incurred.

7. Returns Policy Compliance

7.1 The Returns Policy forms an essential and binding part of these Terms and Conditions. No return will be accepted under any circumstances unless it is carried out strictly in accordance with the Returns Policy and the prescribed returns procedure. Jamal Catering Equipment's Ltd reserves the absolute right to refuse, reject, or dispose of any goods returned without prior authorisation or not returned in full compliance with the applicable procedure.

7.2 Return Request Timeframe: All return requests must be submitted using the Company's official returns form within fourteen (14) days of delivery. Return requests submitted outside of this period will be automatically rejected, and no return, refund, or credit will be permitted under any circumstances.

7.3 Condition of Returned Goods: All returned goods must be unused, uninstalled, undamaged, and returned in their original packaging, complete with all accessories, components, documentation, and manuals originally supplied. Any goods returned incomplete, damaged, used, installed, or not in original packaging may be rejected outright or accepted at the Company's sole discretion with additional deductions applied.

7.4 Return Shipping Responsibility: All return shipping, transportation, insurance, and handling costs shall be borne entirely by the Customer, unless the goods are confirmed by Jamal Catering Equipment's Ltd to be faulty or damaged at the time of delivery. In the absence of such confirmation, no return shipping costs shall be reimbursed under any circumstances.

7.5 Where Jamal Catering Equipment's Ltd offers, at its own cost, a repair or replacement (including arranged collection) and the Customer elects to decline such remedy and instead requests a refund, the return shall be treated as a change-of-mind return. In such circumstances, the Customer shall be solely responsible for all return transportation, handling, and associated costs, and no return costs shall be reimbursed.

8. Restocking Fees

8.1 Restocking Fee – Other Brands: All goods supplied from brands other than those expressly exempted by Jamal Catering Equipment's Ltd shall be subject to a restocking fee of twenty-five percent (25%) of the original purchase price if returned unused, uninstalled, and in fully resalable condition. The application of the restocking fee shall be at the Company's sole discretion.

8.2 Restocking Fee – New Items: All new items, if approved for return and returned unused, uninstalled, and in fully resalable condition, shall be subject to a restocking fee of twenty-five percent (25%) of the original purchase price. The application of this restocking fee shall be at the sole discretion of Jamal Catering Equipment's Ltd.

8.3 Restocking Fee – Used Items: All used items, if approved for return and returned unused, uninstalled, and in fully resalable condition, shall be subject to a restocking fee of fifteen percent (15%) of the original purchase price. The application of this restocking fee shall be at the sole discretion of Jamal Catering Equipment's Ltd.

9. Returns and Refunds – Strict Exclusions

All sales are final upon delivery. No returns, refunds, cancellations, or credits will be accepted after delivery of the equipment under any circumstances, except where the goods are proven to be faulty in accordance with the applicable warranty. Returns or refund requests arising from, including but not limited to, incorrect measurements, failure to fit within the premises, unsuitable or incorrect installation, site conditions, business closure, lease or planning approval failure, change of business plans, chef or staff requirements, or any other change of mind shall be strictly refused. Acceptance of delivery constitutes irrevocable acceptance of the goods supplied.

10. Unauthorised Returns

No returns shall be accepted at the Company's location without the prior written consent of Jamal Catering Equipment's Ltd. Any goods delivered or returned without such authorisation shall be refused, rejected, or disposed of at the Customer's risk and expense, and shall not give rise to any entitlement to a refund, credit, or return.

11. Return Time Limit

No goods shall be accepted for return after fourteen (14) days from the date of delivery. Any return request or attempted return outside this period shall be automatically refused, with no entitlement to a refund, credit, or exchange under any circumstances.

12. Rejected Returns

Where a return is rejected due to use, damage, missing or unsuitable packaging, hygiene concerns, or non-compliance with the Returns Policy, the Customer shall be required to arrange collection of the goods within seven (7) days of notification. If the goods remain uncollected for fourteen (14) days, Jamal Catering Equipment's Ltd reserves the right to dispose of, resell, or otherwise deal with the goods at its sole discretion, without further notice and without liability to the Customer.

13. Refund Policy

Refund Approval Process: All refund requests are subject to prior approval by Jamal Catering Equipment's Ltd Customer Service Department. Each request will be evaluated strictly in accordance with these Terms and Conditions. No refund shall be issued unless and until written approval is granted. Once approved, any applicable refund will be processed within seven (7) to fourteen (14) days from the date of approval.

Refund Deductions: Refunds shall be issued only following inspection and approval by Jamal Catering Equipment's Ltd and may be reduced or refused where the returned goods show any signs of use, installation, damage, alteration, or where any parts, accessories, or documentation are missing.

14. Installation and Use of Goods

The Customer is solely responsible for ensuring that all electrical, gas, and water supplies are suitable, compliant, and compatible with the goods supplied.

All gas-powered equipment must be installed by a Gas Safe registered engineer. All electrical equipment must be installed by a suitably qualified electrical engineer, and all appliances requiring a water connection must be installed by a qualified plumber.

Jamal Catering Equipment's Ltd shall accept no liability whatsoever for any damage to goods, personal injury, property damage, loss, or consequential loss arising from incorrect, improper, or unauthorised installation, connection, modification, or use of the goods. The Company reserves the right to request and require installation, commissioning, and service engineer reports as a condition of any warranty claim. Failure to provide such documentation may result in the warranty claim being rejected in full.

15. Warranty

New Equipment: All new equipment supplied by Jamal Catering Equipment's Ltd is covered by the manufacturer's warranty. Depending on the product and manufacturer, this may include either one (1) year parts-only warranty, or one (1) year parts and labour warranty. The scope, response time, and conditions of any manufacturer's warranty are governed solely by the manufacturer's terms. Proof of purchase and compliance with installation and usage requirements may be required to validate any warranty claim.

Used Equipment: All used equipment supplied by Jamal Catering Equipment's Ltd includes a three (3) month back-to-base parts-only warranty, unless otherwise stated in writing. Under this warranty, the Customer is responsible for returning the equipment or defective part to the Company for inspection and repair. Labour, call-out charges, transportation, installation, and removal costs are expressly excluded.

16. Initial Faults (First 14 Days)

If an item is found to be not working on delivery or within fourteen (14) days from the invoice date, Jamal Catering Equipment's Ltd may, at its discretion, offer an exchange or refund of the price paid.

It is the Customer's responsibility to report any such fault in writing within this 14-day period, supported by appropriate evidence, which may include (but is not limited to): an initial installation or commissioning report from a qualified engineer, clear photographs and/or video evidence. Failure to provide sufficient supporting evidence within this timeframe may result in the claim being rejected. Equipment not installed by a suitably qualified engineer will not be eligible for warranty, and any related claim will be rejected. After fourteen (14) days from the invoice date, standard warranty terms shall apply.

17. Warranty Claim Procedure (Mandatory)

Warranty claims can ONLY be opened by submitting the required information via the Company's official Warranty Service Form. Warranty claims submitted by email, telephone, or any other method will not be accepted or recognised. Failure to follow this procedure will result in the warranty claim being automatically rejected.

Warranty Coverage: Unless otherwise stated in writing, all applicable warranties are parts-only warranties. No labour, call-out, engineer, removal, installation, or travel costs are covered. A parts-only warranty allows the Customer to appoint their own fully qualified engineer at their own cost to diagnose the issue.

18. Engineer Report Requirements

For all warranty claims, the Customer must provide a full engineer's report on official letterheaded paper (PDF format) and supporting photographs evidencing the fault. This documentation must be submitted within thirty (30) days of the fault being reported. Any warranty claim submitted without a qualified engineer's report and supporting evidence will be rejected. Failure to submit the required documentation within 30 days will result in the warranty claim being void.

19. Manufacturer Approval and Parts Supply

Once the warranty claim is reviewed and approved, the documentation will be forwarded to the manufacturer. Upon manufacturer approval, replacement parts will be dispatched to the Customer's nominated address.

Manufacturers may require that defective parts are returned. Failure to return defective parts upon request will result in the Customer being fully invoiced for the replacement parts supplied.

20. Parts Lead Times

Jamal Catering Equipment's Ltd will make reasonable efforts to expedite parts; however, parts lead times may be between three (3) and four (4) weeks, or longer depending on availability and supplier location. Delays in parts supply do not constitute grounds for a refund or compensation.

21. Back-to-Base Warranty (Where Applicable)

Where a Back-to-Base warranty is offered at the Company's discretion: The Customer is responsible for returning the goods to the Company at their own cost. Jamal Catering Equipment's Ltd will cover the cost of returning the goods after repair. If no fault is found, or if the fault is due to poor maintenance, misuse, or unhygienic condition (including strong odours or food residue), the goods will be returned and all costs shall be borne by the Customer.

22. Inspection of Returned Faulty Goods

Where a fault is reported within the first 14 days and the Company agrees to arrange return, Jamal Catering Equipment's Ltd reserves the right to inspect the goods upon receipt. If no fault is found, or if the fault has arisen due to poor maintenance or misuse, the Company shall have no liability and the Customer shall be responsible for collection and associated costs.

23. Limitation of Liability

Jamal Catering Equipment's Ltd shall not be liable for any loss of profit, loss of business, downtime, or business interruption arising directly or indirectly from faulty or defective equipment. It is the Customer's responsibility to plan for contingencies when operating commercial equipment.

24. Professional Equipment & Power Requirements

Jamal Catering Equipment's Ltd supplies professional commercial catering equipment, which may require power levels exceeding domestic appliances. It is the Customer's responsibility to ensure electrical circuits are sufficient for the equipment and where required, appliances are hardwired by a qualified electrician. Inadequate power supply or site limitations do not constitute a product fault or warranty issue.

25. Warranty Exclusions

The warranty does not cover faults, defects, damage, or failures arising from or caused by any of the following:

  • Incorrect, improper, or uncertified installation
  • Installation carried out by unqualified or non-certified personnel
  • User error, misuse, abuse, or overloading of equipment
  • Lack of routine servicing, maintenance, cleaning, or poor hygiene standards
  • Limescale build-up, corrosion, or water-related damage
  • Fair commercial wear and tear
  • Damage occurring during transportation, relocation, or movement on site after delivery
  • Glass breakage or cosmetic damage that does not affect functionality
  • Refrigerant or gas refills, pressure loss, or top-ups
  • Consumable items, including but not limited to: bulbs, fuses, seals, belts, filters, oil, handles, baskets, elements, and lids
  • Electrical, gas, drainage, or plumbing faults at the Customer's premises
  • Damage caused by fire, flood, grease build-up, pests, vermin, or environmental conditions
  • Unauthorised repairs, modifications, alterations, or tampering
  • Failure to operate or maintain the equipment in accordance with the manufacturer's instructions or specifications

26. Product-Specific Warranty Exclusions

In addition to the above, the following product-specific exclusions apply:

  • Ice Cream Machines – Daily cleaning is mandatory. Blockages, contamination, or hygiene-related faults are not covered.
  • Slush Machines – Damage or faults caused by incorrect syrup-to-water ratios, freezing of barrels, or improper operation are excluded.
  • Coffee Machines – Limescale damage resulting from the absence or incorrect use of water filters is not covered.
  • Refrigeration Equipment – Units must be installed with adequate ventilation clearance. Overheating or compressor failure caused by restricted airflow or obstruction is excluded.
  • Ovens and Mixers – Damage resulting from incorrect electrical supply, phase imbalance, inadequate power capacity, or overloading is not covered.

Disclaimer: Damage to glass and/or broken glass are not covered under Warranty. Gas refilling of refrigerated equipment is not covered under Warranty. Consumable parts, including bulbs, batteries, and oil, are not covered under Warranty.

27. Fraud and Chargebacks

27.1 The submission of false, misleading, or inaccurate information to a bank, card issuer, or payment provider in relation to cancellations, deliveries, refunds, or warranty procedures may constitute fraud. Jamal Catering Equipment's Ltd reserves the right to recover all losses, costs, damages, fees, and interest incurred as a result of such actions.

27.2 Where a chargeback or payment dispute is initiated contrary to or outside the scope of these Terms and Conditions, Jamal Catering Equipment's Ltd reserves the right to pursue recovery through civil proceedings and to provide relevant documentation and evidence to payment providers, financial institutions, card schemes, and, where appropriate, regulatory or enforcement authorities.

28. Customer Responsibilities

  • The Customer is responsible for ensuring that all information provided at the time of ordering is accurate, complete, and correct, including but not limited to product selection, specifications, dimensions, site requirements, and delivery details.
  • The Customer shall ensure that the premises, access routes, utilities, and site conditions are suitable and compliant for delivery, installation, and operation of the goods.
  • The Customer is responsible for ensuring that all equipment is installed, commissioned, operated, and maintained in accordance with the manufacturer's instructions and by suitably qualified and certified personnel.
  • The Customer shall ensure ongoing routine maintenance, servicing, and cleaning of the goods and maintain appropriate records where required for warranty purposes.
  • The Customer is responsible for inspecting the goods upon delivery and promptly reporting any shortages, damage, or faults in accordance with these Terms and Conditions.
  • The Customer shall not misuse, modify, alter, relocate, or repair the goods without proper authorisation and shall ensure that the goods are used only for their intended commercial purpose.
  • The Customer is responsible for compliance with all applicable laws, regulations, and industry standards, including health and safety, gas, electrical, and environmental requirements.
  • The Customer shall cooperate fully with Jamal Catering Equipment's Ltd in relation to any warranty claim, inspection, return, or dispute, including providing documentation, access, and evidence as reasonably requested.

29. Misuse & Abuse Policy

29.1 Jamal Catering Equipment's Ltd maintains a zero-tolerance policy towards abusive, threatening, aggressive, or harassing behaviour directed at its staff, representatives, or agents.

29.2 In instances of such behaviour, Jamal Catering Equipment's Ltd reserves the right to:

  • Refuse service, communication, or access to any individual engaging in abusive, aggressive, or harassing conduct;
  • Cancel any open orders and issue a refund where appropriate, at the Company's discretion;
  • Report threats, harassment, or abusive conduct to the relevant authorities, including the police, and provide any supporting evidence such as call recordings, messages, emails, or other communications.

29.3 This policy does not limit any other legal rights or remedies available to Jamal Catering Equipment's Ltd under contract, tort, or statute.

30. Termination of Service

30.1 Jamal Catering Equipment's Ltd reserves the right to suspend or terminate the supply of goods, support, or services immediately if the Customer: Breaches any of these Terms and Conditions; Provides false, misleading, or inaccurate information; Misuses or abuses the goods supplied; or Engages in abusive, threatening, or fraudulent conduct.

30.2 Termination of supply or service shall not affect any rights, obligations, or liabilities that have accrued prior to termination, including the right to recover payment, enforce warranty exclusions, or claim damages.

30.3 Termination may be enforced without notice where the Company reasonably considers it necessary to protect staff, assets, or business operations.

31. Terms and Conditions of Website Usage

31.1 These website terms govern access to and use of the Jamal Catering Equipment's Ltd website. By using this website, you agree to be bound by these Terms and Conditions.

31.2 The website is provided for general information and ordering purposes only. While Jamal Catering Equipment's Ltd makes reasonable efforts to ensure that information on the website is accurate, we do not guarantee that product descriptions, specifications, pricing, availability, images, or other content are complete, current, or free from errors.

31.3 Product images are for illustrative purposes only and may not reflect the exact appearance of the goods supplied.

Where false or misleading information is provided to a payment provider or bank in relation to a warranty claim or dispute, Jamal Catering Equipment's Ltd reserves the right to commence legal proceedings to recover costs, interest, and damages.

33. Termination

Jamal Catering Equipment's Ltd reserves the right to cancel, suspend, or terminate any order or contract at any time where payment has not been received, where a payment has failed, or where the Customer fails to satisfy the Company's credit checks or payment approval requirements. Such cancellation or suspension shall be without liability to the Company and without prejudice to any other rights or remedies available under law.
